Members of the team appreciate that mediation can provide an efficient and cost-effective means of resolving disputes and allow the parties to reach solutions which cannot be obtained through litigation. Courts have repeatedly stressed the importance of mediation and highlighted the potential costs implications to parties who do not mediate.
Mediation’s increasing importance and the cost of litigation puts the onus on parties and their representatives to be proactive, and to take steps to ensure that they have the best chances of succeeding. One of the ways of doing so is to take care in the choice of mediator. Experience shows that a mediator with knowledge of the subject area is generally better able to assist parties to appreciate the merits of their case, the implications of the various courses of action open to them, and to explore possible bases of settlement. As a result, the chances of settling are generally greater.
Our comfortable, modern offices provide the ideal neutral environment to reach acceptable solutions to any real estate matters. The solution need not be, and often is not, an outcome that a judge might or could properly impose through a decision of the court. It can be a “win-win” solution.
When he was Vice President of the Court of Appeal, Sir Henry Brooke said (in the case of Dunnett v Railtrack [2002] EWCA Civ 302):
“Skilled mediators are now able to achieve results satisfactory to both parties in many cases that are quite beyond the power of the lawyers and courts to achieve.”
